TERMS OF SERVICE

Welcome to InvestCalgary, a real estate investment platform operated by JN Real Estate Group ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the InvestCalgary website, applications, and services (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you and JN Real Estate Group. We may update these Terms from time to time, and your continued use of the Platform after such updates constitutes acceptance of the modified Terms.

To access certain features of the Platform, you must create an account. By creating an account, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to enter into these Terms
• All information you provide during registration is accurate, current, and complete
• You will maintain and promptly update your account information as necessary

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Use a strong, unique password for your account
• Notify us immediately if you suspect unauthorized access to your account
• Never share your login credentials with others
• Log out of your account when using shared or public devices

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

• Scrape or harvest data: Use automated systems, bots, or scrapers to extract data from the Platform without our written consent
• Circumvent security: Attempt to bypass, disable, or interfere with any security features or access controls
• Impersonate others: Create accounts using false identities or misrepresent your affiliation with any person or entity
• Harass or abuse: Use the Platform to harass, threaten, or harm other users or our staff
• Engage in fraud: Use the Platform for any fraudulent, deceptive, or illegal purposes
• Distribute malware: Upload or transmit viruses, malware, or any code designed to disrupt the Platform
• Commercialize without permission: Resell, redistribute, or commercially exploit Platform data without our written consent
• Overload systems: Intentionally impose an unreasonable load on our infrastructure

Violation of these acceptable use policies may result in immediate suspension or termination of your account and may be reported to appropriate authorities.

InvestCalgary includes Pixie, an AI-powered investment assistant designed to help you analyze properties and understand investment metrics. By using Pixie, you acknowledge and agree that:

• Estimates, not guarantees: Pixie provides estimated calculations based on available data and assumptions. Actual results may vary significantly.
• Not a licensed advisor: Pixie is not a licensed real estate agent, financial advisor, or investment professional. Its responses do not constitute professional advice.
• Data limitations: Pixie's analysis is limited to the data available in our system. Some information may be outdated, incomplete, or inaccurate.
• Verify independently: You should always verify important information with appropriate professionals before making investment decisions.
• Conversation storage: Your conversations with Pixie are stored as described in our Privacy Policy.

We continuously improve Pixie's capabilities and accuracy, but cannot guarantee error-free responses. Use Pixie as one tool among many in your investment research process.

No Investment Advice: The information, data, calculations, and analysis provided on the Platform are for general informational purposes only. They are not intended to be, and should not be relied upon as:

• Investment advice or recommendations
• Financial or tax advice
• Legal advice
• A substitute for professional consultation

Data Accuracy: Property information displayed on the Platform is sourced from the Calgary Real Estate Board (CREB) via the Pillar9/Matrix MLS system. While we strive for accuracy, we cannot guarantee that all information is complete, accurate, or current. Properties may have conditions, defects, or circumstances not reflected in the data.

Investment Risk: Real estate investment involves significant financial risk, including the potential loss of your entire investment. Past performance of any property or market does not guarantee future results. You assume all responsibility for your investment decisions.

Professional Consultation: Before making any real estate investment, you should consult with:

• A licensed real estate professional for property-specific advice
• A financial advisor for investment suitability
• A tax professional for tax implications
• A lawyer for legal review of transactions

Our Intellectual Property: The Platform, including its design, code, features, branding, and original content, is owned by JN Real Estate Group and is protected by copyright, trademark, and other intellectual property laws.

• Our original analysis tools, calculators, and AI features are proprietary
• Website design, user interface, and user experience are protected by copyright

MLS Data: Property listing data is provided under license from the Calgary Real Estate Board (CREB) via the Pillar9/Matrix system. This data is subject to additional terms and restrictions:

• Listing data may only be used for personal, non-commercial purposes
• You may not copy, distribute, or republish listing data
• The accuracy of listing data is not guaranteed by CREB or JN Real Estate Group

Your Content: You retain ownership of content you create on the Platform (such as notes or custom analysis parameters). By submitting content, you grant us a non-exclusive license to use, store, and display that content in connection with providing our services.

Restrictions: You may not copy, modify, distribute, sell, or lease any part of the Platform or its content, nor may you reverse engineer or attempt to extract source code, except as permitted by law or with our written consent.

Disclaimer of Warranties: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Platform will be uninterrupted, timely, secure, or error-free
• The information provided will be accurate, complete, or current
• Results from using the Platform will meet your requirements
• Any errors in the Platform will be corrected

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, JN REAL ESTATE GROUP AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Investment losses or poor investment outcomes
• Decisions made based on information from the Platform or Pixie
• Third-party actions or the conduct of other users

Maximum Liability: In no event shall our total liability to you exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim, or $100 CAD, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Termination by You: You may terminate your account at any time by:

• Contacting us at invest@jnrealestate.ca to request account deletion
• Upon termination, your account and associated data will be deleted in accordance with our Privacy Policy

Termination by Us: We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, if:

• You violate these Terms or our acceptable use policies
• We reasonably believe your conduct may harm us, other users, or third parties
• We are required to do so by law
• We discontinue the Platform or any part of it

Effect of Termination: Upon termination:

• Your right to access and use the Platform immediately ceases
• All provisions of these Terms that should survive termination shall survive (including intellectual property, limitation of liability, and governing law sections)
• We are not liable to you for any termination of your access to the Platform

Governing Law: These Terms and any disputes arising out of or related to them or the Platform shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Jurisdiction: You agree that any legal action or proceeding arising out of or related to these Terms or the Platform shall be brought exclusively in the courts located in Calgary, Alberta, Canada. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution: Before initiating any legal proceeding, you agree to first contact us at invest@jnrealestate.ca to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days.

Class Action Waiver: To the maximum extent permitted by law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

We reserve the right to modify these Terms at any time. When we make changes:

• Minor changes: The "Last updated" date at the top will be revised
• Significant changes: We will notify you via email to your registered address
• Material changes: We will provide prominent notice on the Platform before changes take effect

Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Platform and may request deletion of your account.

We encourage you to review these Terms periodically. The version of these Terms posted on the Platform at the time of your use governs that use.
